Terms of Use & Disclaimers

1. Eligibility

1.1 The Service is available only to individuals who are 18 years of age or older. By using the Service you represent and warrant that you are at least 18.

1.2 If we learn that a user is under 18, we may suspend or delete the account and any associated content.

1.3 You must have the legal capacity to enter into a binding agreement and must not be barred from using the Service under applicable law.

2. The Service

2.1 Performers AI is a multi-sport video-analysis platform. You upload match, bout, or training video and the Service uses artificial intelligence to track athletes, apply the relevant sport's ruleset, and produce a scored breakdown, statistics, and 2D/3D replays.

2.2 The Service currently supports Jiu-Jitsu (analysed against the IBJJF ruleset). Additional sports and features may be added, changed, or withdrawn over time.

2.3 AI output is an automated estimate, not official scoring. See Section 9 (Disclaimers) and our AI Disclaimer.

3. Accounts

3.1 You must provide accurate registration information and keep it current.

3.2 You are responsible for safeguarding your credentials and for all activity under your account.

3.3 Notify us at [email protected] of any unauthorised use of your account.

4. Credits, payments and refunds

4.1 Analysis is consumed using credits. New users may receive a number of free credits; further credits may be purchased. Applicable prices are shown at the point of purchase.

4.2 Payments are handled by third-party payment providers. We do not store full payment-card details.

4.3 Credits have no cash value, are non-transferable, and, except where required by applicable law, are non-refundable.

4.4 We may change pricing prospectively; changes do not affect credits already purchased.

5. User content and uploaded video

5.1 "User Content" means any video, image, text, or other material you upload or create on the Service, including derived analysis, overlays, and 3D reconstructions.

5.2 You retain ownership of your User Content.

5.3 You grant Performers AI a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, and create derivative works from your User Content to operate and provide the Service to you — including running AI analysis, generating replays and statistics, and, where you choose to share, displaying it to other users.

5.3.1 You also agree that we may use your User Content and the data derived from it (such as movement and pose data) to develop, train, test, and improve our AI models and the Service. You can opt out of this training use at any time in your account settings or by emailing [email protected]; opting out stops future use for training but does not affect models already trained. Where required by law, we rely on your consent for this use, which you may withdraw at any time.

5.4 Uploaded video frequently shows other identifiable people (opponents, teammates, coaches, spectators). You represent and warrant that, for all material you upload, you have the necessary rights and have obtained all consents required to upload it and to have it processed and (if you choose) shared through the Service, including the consent of any identifiable individuals appearing in it. You are solely responsible for obtaining such consents.

5.5 You must not upload content that is unlawful, infringing, defamatory, obscene, or that you do not have the right to upload. We may remove content and suspend accounts for breach.

5.6 Do not upload footage recorded where participants had a reasonable expectation of privacy without their consent.

6. Sharing and community features

6.1 Your uploads and analyses are private by default. You choose whether to make them public or share them via any feed, friends, or messaging features.

6.2 If you share content publicly or with others, you grant those users the ability to view it in line with the feature used. You are responsible for what you choose to share.

6.3 Community features may be released progressively; some may not yet be available.

7. Acceptable use

You agree not to: (a) reverse engineer, scrape, or misuse the Service or its AI outputs; (b) upload malware or attempt to disrupt the Service; (c) use the Service to harass, defame, or infringe others' rights; (d) resell or commercially exploit AI outputs except as expressly permitted; or (e) use the Service for any unlawful purpose or in breach of applicable law.

8. Intellectual property

8.1 The Service, including software, models, interfaces, and branding, is owned by or licensed to Performers AI and is protected by law. Except for the rights expressly granted, no rights are transferred to you.

8.2 "Performers AI" and associated logos are marks of Top Netics Technologies L.L.C.

9. Disclaimers

9.1 AI analysis is an automated estimate, not official scoring, refereeing, or adjudication. It may contain errors and must not be relied upon as authoritative. It does not replace a qualified referee, judge, official, or coach.

9.2 The Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law, including fitness for a particular purpose, accuracy, or uninterrupted availability.

9.3 The Service is not medical, health, training, safety, or professional advice. Combat and physical sports carry inherent risk; you participate at your own risk and should consult qualified professionals.

9.4 We do not warrant that analysis, scores, statistics, or 3D reconstructions are accurate or complete.

10. Limitation of liability

10.1 To the maximum extent permitted by law, Performers AI and Top Netics Technologies L.L.C will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill.

10.2 Our aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100.

11. Indemnity

You agree to indemnify Performers AI against claims arising from your User Content, your breach of these Terms, or your violation of any law or third-party right (including the rights of people appearing in your uploads).

12. Suspension and termination

12.1 We may suspend or terminate your access for breach of these Terms or where required by law.

12.2 You may stop using the Service and request account deletion at any time (see the Privacy & Cookie Policy).

12.3 Sections that by their nature should survive termination (including 5.2–5.5, 8, 9, 10, 11, and 13) will survive.

13. Governing law and disputes

13.1 These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai.

13.2 The courts of Dubai have exclusive jurisdiction over any dispute, subject to any mandatory consumer rights.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a revised "Effective date"; continued use after changes constitutes acceptance.
